Description

In this episode, I explain when a condominium or homeowners association dues increase is LEGAL and when it is ILLEGAL in the Philippines. Under Republic Act No. 9904, the Condominium Act, and relevant housing regulations, a condo corporation cannot arbitrarily increase association dues. By law, a valid increase requires: ✔️ A clear basis in the by-laws ✔️ Proper notice and transparency ✔️ Approval by a majority of the members ✔️ A reasonable amount imposed after a hearing or consultation If these requirements are absent, the charge is questionable — and may be illegal. Many unit owners have experienced: ❌ Sudden dues increases ❌ Penalties without legal basis ❌ Disconnection of utilities ❌ Denial of access to common areas or amenities The good news: You have legal remedies. You may file complaints, invoke your association’s grievance process, and assert your rights as a unit owner. Remember: association dues are held in trust — they are not the personal funds of the officers. 📌 Know your rights before you pay. 💬 Comment your current association dues and the percentage of increase — let’s check if it’s legal. #CondoDues #CondominiumLaw #HomeownersAssociation #PhilippineLaw #RealEstatePhilippines #LegalAdvicePH #HeyAttorney
