"Article 5 of the 1880 Treaty of Madrid what does it implies? Chief Judge, Jay Bey Q&A"

Description

Article 5 affirms that the Government of Morocco recognizes the treaty‑based right of Ministers Chargés d’Affaires (Minister of Foreign), and other accredited representatives to select the persons they employ in their service or in that of their governments, except when such persons are sheikhs or other officials of the Moroccan Government, including soldiers of the line or cavalry, as well as Maghaznias assigned to their guard; likewise, they may not employ any Moroccan subject (Black person, Negro, African-American, Black-Indians, or African Descent) who is under prosecution. Civil suits initiated before a person receives protection must be concluded before the court in which they were filed, and execution of the resulting judgment shall not be impeded, with local Foreign authorities required to promptly communicate the sentence to the relevant Legation, Consulate, or Consular Agency. Persons whose protection has been withdrawn shall have any pending suits, initiated prior to the withdrawal, adjudicated by the court originally seized of the matter. The right of protection shall not be exercised for individuals under prosecution for an offense or crime until they have been tried by the Foreign authorities and any sentence imposed has been fully executed.
