The party at fault or the rogue is aware that the innocent party is making a mistake. The rogue/party at fault makes not mistake himself. The rogue, aware of the innocent party’s mistake, seeks to take advantage of the innocent party’s mistake. The most common example of unilateral mistake is mistake as to the identity of a contracting party.
